Terms of Use

Terms, in plain English.

1. Who can use SoberHearted

You must be at least 18 years old and legally able to enter a contract. You must not have been previously removed from SoberHearted. You may hold one account.

2. What SoberHearted is, and isn’t

SoberHearted is a community and dating service for people in recovery. It is not a treatment program, medical service, crisis service, or substitute for professional help, and nothing on it is medical advice. We do not verify anyone’s sobriety. We do not run criminal background checks on members. If you are in crisis, call or text 988; if you are in danger, call 911.

3. Your account

You sign in with a one-time link sent to your email; keep that inbox secure. You are responsible for what happens under your account. Tell us at safety@soberhearted.com if you think it’s been accessed by someone else.

4. Your content

You own what you post. You give us a non-exclusive, worldwide, royalty-free license to host, store, resize, blur, and display it to other members as the service requires, which ends when you delete it or your account. You confirm you have the right to post it and that it is of you, recent, and honest. We may remove content that breaks the Guidelines.

5. Conduct

You agree to follow the Community Guidelines. You will not harass, scam, impersonate, scrape, automate, reverse-engineer, or interfere with the service or other members; use it for any commercial purpose; or post content that is illegal, sexually explicit without invitation, hateful, or involves minors. We may warn, pause, or remove accounts that break these terms, with or without notice.

6. Safety and meeting people

You are solely responsible for your interactions with other members, online and in person. We don’t screen members beyond what the Safety page describes, and we make no guarantees about anyone’s identity, intentions, or sobriety. Please read the Safety page before meeting anyone.

7. Fees

SoberHearted is currently free for founding members. If we ever introduce paid features, we will say so clearly before you pay anything, and nothing on a card statement will reveal sobriety.

8. Ending things

You can delete your account at any time from your settings; it takes effect immediately. We may suspend or terminate accounts that break these terms. Sections 4 (as to a retained hashed record for safety), 9, 10, and 11 survive termination.

9. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent allowed by law. We don’t promise the service will be uninterrupted, error-free, or that you will find a match.

10. Limitation of liability

To the fullest extent allowed by law, SoberHearted and its people are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the service or your interactions with other members. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or US$100.

11. Disputes

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. You agree to try to resolve any dispute with us informally first by writing to hello@soberhearted.com. Any dispute not resolved within 60 days will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.

12. Changes

We may update these terms. If a change is material, we’ll tell you by email or in the app before it takes effect. Continuing to use SoberHearted after that means you accept the new terms.

13. Contact

hello@soberhearted.com

These terms are written to be understood, but they are not legal advice to you. If you have questions about your rights, talk to a lawyer.
